Lanre Gentry faces 7 years in jail in fresh police case

 

The case against Olanrewaju Gentry, the estranged husband of star actress, Mercy Aigbe, borders on breach of the peace, physical assault and causing grievous bodily harm.

Up against the Office of the Public Defender, Ministry of Women Affairs and Poverty Alleviation and Domestic and Sexual Assault Response Team, the 52 year old hotelier and auto merchant is being tried before Mrs. Y. O.  Aje Afunwa of Rosaline Omotoso Court in Ikeja (Lagos).

Heard on Tuesday, May 9, the case was adjourned to Wednesday, July 12.

However, only one of the three sections (157, 168 and 171) of the Criminal Law of Lagos State 2011 under which he’s been tried is applicable.

He should have been charged under sections 54, 171 and 243 .

And the sections stipulate 6 months minimum and maximum of seven years imprisonment if diligently prosecuted and found liable.

 

Chapter 8, Section 54 states:

  1. Affray. Any person who takes part in a fight in a public place is guilty of an offence, and is liable to imprisonment for six months.

 

Here are the details of Chapter 21, section 171:

Assault and Violence to the Person generally Justification and excuses.

171: Assaults occasioning harm.

Any person who unlawfully assaults another and thereby does him harm is guilty of a felony, and is liable to imprisonment for three years.

 

And Chapter 24, section 243 stipulates:

Offences Endangering Life or Health

  1. Grievous harm.

Any person who unlawfully does grievous harm to another is guilty of a felony and is liable to imprisonment for seven years.
